Terms of Service of service

These Terms of Service ("Terms") govern your access to and use of Gallery4you ("the Service"), operated by Gallery4you. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By accessing or using Gallery4you, you confirm that you are at least 18 years old or the age of majority in your jurisdiction, and that you have the legal capacity to enter into this agreement. If you use the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Your Account

To use most features of the Service, you will need to register an account. You agree to:

• Provide accurate, current, and complete information during registration and keep it up to date.
• Keep your password confidential and accept responsibility for all activity that occurs under your account.
• Notify us immediately at support@gallery4you.com of any unauthorized use of your account.

3. Permitted Use

You may use Gallery4you to store, organize, and share photographs for which you hold the necessary rights. You retain full ownership of your content. You grant Gallery4you a limited license to host, display, and deliver your content solely to operate the Service.

You must not

• Upload content you do not own or have permission to distribute, or content that infringes intellectual-property or privacy rights.
• Use the Service to distribute illegal, defamatory, harassing, sexually explicit, or otherwise objectionable material.
• Attempt to reverse-engineer, probe, scan, or otherwise interfere with the security or integrity of the Service.
• Resell, sublicense, or white-label the Service without a written agreement with us.

4. Your Content

You remain the sole owner of the photographs and other content you upload. We do not claim any ownership rights in your content.

You are solely responsible for the lawfulness of your content and for obtaining any model releases, permissions, or consents required to publish or share it through the Service.

5. Subscriptions & Billing

Paid plans are billed in advance on a monthly or annual basis through our payment processor (Paddle). By subscribing you agree that:

• Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
• You are responsible for all applicable taxes and for keeping your billing information current.
• Prices may change; we will notify you at least 30 days in advance of any price increase affecting your subscription.

6. Suspension & Termination

We may suspend or terminate your account if you materially breach these Terms, fail to pay fees when due, or use the Service in a way that risks harm to us or other users. You may cancel your account at any time from your dashboard. Upon termination, your content may be deleted after the retention period described in our Privacy Policy.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content will be preserved without loss.

8. Limitation of Liability

To the maximum extent permitted by law, Gallery4you will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total aggregate liability for any claim arising out of the Service will not exceed the fees you paid us in the twelve months preceding the event giving rise to the claim.

9. Changes to the Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or via the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which Gallery4you is established, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms will be resolved exclusively in the competent courts of that jurisdiction, unless mandatory consumer-protection laws grant you a different venue.
